Governor
What constitutional or statutory duties does the governor have as it relates to education? The chief executive power of the state shall be vested in a governor.

He shall take care that laws be faithfully executed.

The governor shall have the power to veto single items in appropriations bills, and any provision in new bills declaring an emergency, without thereby affecting any other provision of such bill.

Every bill which shall have passed the legislative assembly shall, before it becomes law, be presented to the governor. If he approves, he shall sign it. If not, he shall send it back to the house in which it originated.

The governor shall be the superintendent of public instruction.
What is the appointment authority provided to the governor in education? The governor appoints seven members of the state board of education subject to confirmation by the senate.

Legislature
What constitutional or statutory powers does the legislature have as it relates to education policy? The legislative power of the state, except for the initiative and referendum powers reserved to the people, is vested in a legislative assembly, consisting of a senate and a house of representatives.

The legislative assembly shall provide by law for the establishment of a uniform general system of common schools.

The legislative assembly shall appropriate each biennium a sum of money sufficient to ensure that the state's system of public education meets quality goals established by law.
What is the appointment or confirmation authority of the legislature in education? The governor's appointments to the state board of education and for the position of deputy superintendent of public instruction are subject to senate confirmation.

Chief State School Officer
What are the duties of the chief state officer? The governor shall be the superintendent of education.

The superintendent of public instruction shall act as the administrative head of the department of education.

The superintendent shall assist school boards and education service district boards in answering questions concerning the proper administration of school laws and rules of the state board of education.

Administer and supervise adult education programs.
What constitutional or statutory authority does the chief state school officer have as it relates to education policy? The superintendent of public instruction shall act as the executive head of the department of education and supervise all activities of the department.

The superintendent may appoint such personnel as may be necessary for the performance of the duties of the office of the superintendent.
How is the chief state school officer selected? The superintendent of public instruction is the governor.

State Board of Education
What constitutional or statutory powers and duties does the state board of education have as it relates to education policy? The state board of education shall consider the modern goals of education when carrying out its duties.

The state board shall establish standards and minimum courses of study for public kindergarten, public elementary, and public secondary schools. The board shall also establish rules for the governance of kindergarten, elementary, and secondary schools.

The board may adopt rules for participation in interscholastic sports and provide that no school shall discriminate in the participation of interscholastic sports.
What is the composition of the state board of education? The state board of education shall consist of the state treasurer, or a designee, the secretary of state, or a designee, five members that represent each of the congressional districts in the state, and two at large members.
How are members of the state board of education selected? The state treasurer and secretary of state, or their designees, are ex officio members of the state board. The five members representing the state's congressional districts and two at large members are appointed by the governor, subject to confirmation by the senate.

Does the state have an executive-level secretary? The governor shall appoint a deputy superintendent of public instruction.
What other duties does the executive-level secretary have? The deputy superintendent of public instruction shall perform any act or duty that is designated by the governor.

The deputy superintendent shall coordinate with the chief education officer.
